These Terms of Use govern your use of Foodari.com and Foodari.co.uk web sites (the "Sites"). The Sites are owned and operated by Foodari ("we" or "us"). All actions performed while on the Sites are subject to this Terms of Service Agreement ("Agreement"). This Agreement declares the legally binding terms of use for all of your activities on the Sites. All users ("Users"), both registered users (Members) and unregistered visitors are subject to this Agreement. All Users should read this Agreement and agree to it prior to use of any Foodari services and Sites. If you do not agree with these terms, you should leave the Site now.
This Agreement is subject to change by Foodari at any time. Changes of this Agreement will take immediately effect upon being posted to the site. They will be posted at http://www.foodari.com/termsofuse and may be reached either directly or via a hyperlink at the bottom of every page. All Users must agree with changes prior to use of the Site.
It is important to frequently check this Agreement prior to using any Foodari Services.

Interactivity & Prohibited Activities

Foodari includes a number of features, including but not limited to user profiles, recipe storage, comments, and private messages, email, blogs and forums that involve feedback and interaction between Users. Responsibility for what is posted lies with each User. This responsibility extends to any possible legal action by a third-party.
By agreeing to this Agreement you agree not to:
Inhibit or restrict any other User from using the Service.
Incite other Users to commit illegal actions or damage to any other person.
Collect contact information for marketing purposes.
Solicit personal information from minors (anyone under the age of 18)
Send or post any message for a commercial purpose.
Gain unauthorized access to the Site, server, network, or User account.
Do anything to disrupt the network or our servers
Use the Site to transmit or post any unlawful, abusive, defamatory, libellous, obscene, pornographic, or indecent information of any nature, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence or otherwise violate any national or international law.
Use the Site to transmit any harmful software.
Reproduce, copy, or redistribute the design or layout of the website, individual elements of the website design, or logos.
Use the website materials and screen shots, reproduction, copying or redistribution for commercial purposes of any materials or design elements on the website is strictly prohibited.
Use the Site for ANY sort of advertising purposes without express written consent from us.
Utilize any sort of automated scripts to access the Site, contact members, or post.
Use Foodari in any nature that is illegal given relevant national or international law.
By accepting this Agreement you understand that we have no obligation to monitor any of the interactive features of the Site. Furthermore you understand that we reserve the right to deny access to the Site to anyone who violates these Terms of Service or interferes with the ability of other Users to use the Site.

Access

When you register for the Site you select a username and password, which constitutes your account. You are solely responsible for all activities performed under your account. It is your responsibility to keep this information private, and to notify us if you feel the privacy of this information has been compromised.

Use of data

Foodari will from time to time communicate with its members using, but not restricted to, e-mail in order to keep them aware of activity, developments and other information which it feels is of use to said membership. By registering with Foodari you grant a full license to communicate in this way.

Intellectual Property Rights

This Site and all the materials available on the Site are the property of Foodari, and are protected by copyright, except when acknowledged to be the work of other parties. The Site is provided solely for your personal use. You may not use Foodari or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us. Moreover, unless explicitly authorized in these Terms of Service or by the owner of the materials, you may not modify, reproduce, copy, republish, post, translate, create derivative works, sell, or distribute in any manner or medium (including any electronic or non-electronic means) any material from the Site for gain or otherwise. Permission is granted to electronically copy and to print in hard copy portions of this site for personal and private use as an informational resource provided that ALL copies retain the copyright and any other proprietary notices contained on the materials.
By posting or submitting any material (including, without limitation to, recipes, comments, photos) to us through the Site, you are representing that you are the owner of said material, or are making your submission or posting with the express consent of the owner of said material. Termination

We reserve the right to terminate your right to use or access to Foodari at any time without notice. If your rights to access the Site have been terminated you are no longer authorized to be a User of the Site or use it in any capacity.

Limitation of Liability

Under no circumstances including but not limited to negligence, shall we be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use Foodari, including its materials or services made available through this site. You acknowledge and agree that we are not liable for any offensive, defamatory or illegal conduct of any user. If you are dissatisfied with the site or with and of the terms and conditions in this agreement, your only remedies to discontinue use of it.

The Site is controlled and operated by Foodari from its office within the United Kingdom. It can be accessed from other countries and as each of these countries has laws that may differ from those of England, by accessing this website both you as the User and Us as Foodari agree that the statutes and laws of England, without regard to the conflicts of laws principles thereof, will apply to all matters relating to use of this website.
You and Us also agree and hereby submit to the exclusive jurisdiction of the English Courts and this agreement shall therefore be governed by and construed in accordance with English Law.
